Justice chief warns Kapa of warrantless arrest

MANILA – Justice Secretary Menardo Guevarra said Tuesday Kapa-Community Ministry International officials and members could face arrest without warrant if they continue to sell investments without a license.

A warrantless arrest is valid if it involves a “continuing crime” and offering and selling investments without a license is the “crux of the crime,” Guevarra told reporters.

“There’s a complaint by the SEC (Securities and Exchange Commission) and there’s an alleged violation of the law, so if they continue to do so, until now, so that’s a continuing offense, you don’t need an arrest warrant for that,” he said.

The SEC on June 18 filed a criminal complaint with the Department of Justice for violation of the Securities Regulation Code against Kapa and 8 of its officers and members after it found that the organization was engaged in a Ponzi scheme.

The SEC said Kapa enticed the public to “donate” at least P10,000 promising a 30 percent monthly “blessing” or “love gift” for life.

Named as respondents in the complaint are Kapa, its founder and president Pastor Joel Apolinario, trustee Margie Danao and corporate secretary Reyna Apolinario. Also included are Marisol Diaz, Adelfa Fernandico, Moises Mopia, Catherine Evangelista and Rene Catubigan.

The DOJ and the Bureau of Immigration placed all of them under an immigration lookout bulletin order. A Davao City regional trial court on Monday issued a precautionary hold departure order against the 8.
